Sessions end 30 minutes after the scheduled start time
Client is required to perform a full warm-up (provided) prior to scheduled start time
Reassessments will take place during regularly scheduled sessions on or around March 31st, June 30th, September 30th, and December 31st.
Insufficient funds may result in loss of Client's reservation in selected time slot
TMack Elite Training reserves the right to anonymously use photos (heads removed), data, and testimonials for marketing and presentation purposes
The term of this Agreement shall commence on the Effective Date and continue for a period of three (3) months after the first date of training ("Initial Term"). Thereafter the term shall automatically renew on a monthly basis until either party terminates this Agreement in accordance with the Terms and Conditions of this Agreement. After the Initial Term, you may cancel the Agrement at any time, upon one (1) week prior notice to Provider. Upon receipt of such notice, TMack Elite Training shall cancel recurring billing and enrollment in reserved personal training and'/or small group training time slot. Client shall be responsible for all fees due through the end of the then, current term, For avoidance of doubt, in the event the Client terminates this agreement during the middle of the applicable term, Client shall not be entitled to a refund.
If TMack Elite Training does not meet for a scheduled session due to illness or emergency, Provider will make every effort to reschedule the missed session within thirty (30) days, on a day and time agreeable to both parties, or provide a prorated credit for such missed session, in Provider's sole and absolute discretion.
TMack Elite Training will make every effort to notify clients at least one (1) week in advance f training absences. Monthly billing will be prorated accordingly. (e.g. vacation, time off extended professional commitments)
The Client acknowledges and agrees that no credit or refund shall be due for sessions missed by Client. TMack Elite Training's total and cumulative liability for direct damages arising out of or in connection with this Agreement shall in no event exceed the fees paid by Clent to TMack Elite Training. In no event will TMack Elite Training be liable for any indirect, incidental, consequential, special or punitive damages even if it has been advised of the possibility of such damages
